Terms & Conditions of Ticket Purchase, Entry, and Liability

PLEASE READ CAREFULLY

THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY AND ASSUMPTION OF RISK RELATING TO EXPOSURE TO COVID-19 OR ANY OTHER COMMUNICABLE OR INFECTIOUS DISEASE, YOUR WAIVER OF CLASS ACTION RIGHTS, AND YOUR AGREEMENT TO BINDING ARBITRATION.

BY PURCHASING A TICKET OR ENTERING THE PREMISES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

I. Ticket Policy and Admission

  1. All Sales Final: All tickets and packages are non-refundable. No refunds, exchanges, or credits will be issued for any reason, including but not limited to illness, weather, travel delays, scheduling conflicts, or dissatisfaction with the event experience.
  2. One-Time Change Policy: Guests may change their ticket one (1) time only to a different available date or time through our third-party ticketing system, subject to availability.
  • If the new date or time is higher in price, the difference must be paid.
  • If lower in price, no credit or refund will be given.
  • After one change, the ticket may not be changed again or refunded for any reason.
  1. Admission:
  • Each ticket admits one (1) person unless otherwise noted.
  • Valid, government-issued photo ID matching the ticket name is required.
  • Entry may be denied for any reason at the Organizer’s discretion, including intoxication, disorderly behavior, or violation of law or venue policy.
  • Re-entry is not permitted.
  1. Age Policy:
  • Frosty’s Christmas Bar Chicago operates as 21+ only.
  • Valid ID is required for all guests.
  • No refunds will be issued for failure to meet age requirements.

II. Assumption of Risk and Waiver of Liability (Including COVID-19 and Infectious Disease)

  1. Assumption of Risk:
    You acknowledge that there is an inherent risk of exposure to COVID-19, SARS-CoV-2, and other communicable or infectious diseases in any public setting. These risks include but are not limited to illness, injury, or death and cannot be completely eliminated regardless of precautions taken.

By attending Frosty’s Christmas Bar Chicago, you voluntarily assume all risks associated with such exposure or transmission, including risks resulting from the negligence or fault of Viper Room Inc. or its affiliates. You acknowledge that your attendance is voluntary and that you may be exposed to or contract illness despite all safety efforts.

  1. Waiver and Release:
    On behalf of yourself and your heirs, executors, administrators, and assigns, you hereby waive, release, and discharge Viper Room Inc., Frosty’s Christmas Bar Chicago, its officers, directors, owners, employees, agents, contractors, affiliates, insurers, successors, and assigns (the “Released Parties”) from any and all claims, liabilities, or damages arising out of or related to exposure to COVID-19 or any other communicable or infectious disease during or after your attendance.

This waiver applies to all claims based on ordinary negligence or other acts or omissions of the Released Parties, to the fullest extent permitted by law.

  1. Acknowledgment for Other Guests:
    If you purchase or provide tickets for others, you represent and agree that all such individuals have independently reviewed and accepted these terms, including this waiver and assumption of risk.
  2. Indemnification:
    You agree to indemnify and hold harmless the Released Parties from and against any claims, losses, damages, or expenses (including reasonable attorneys’ fees) brought by any third party arising from or relating to your attendance, conduct, or violation of these Terms.

III. Health and Safety Acknowledgment

  • Guests must follow all health and safety rules, venue policies, and any applicable orders or guidelines from the City of Chicago, the State of Illinois, or public health authorities.
  • The Organizer reserves the right to refuse entry or remove any guest not complying with safety policies, without refund.
  • You acknowledge that health guidelines are subject to change, and compliance is a condition of entry.

IV. Conduct and Removal

Guests are expected to behave responsibly and respectfully toward staff and other patrons. The Organizer reserves the right to remove or refuse entry to anyone for reasons including, but not limited to:

  • Intoxication or illegal substance use;
  • Harassment, discrimination, or disruptive behavior;
  • Property damage or theft; or
  • Any violation of these Terms or local law.

Removed guests are not entitled to refunds or credits.

V. Limitation of Liability

To the fullest extent permitted by law, the Released Parties shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from attendance at the event or any related activities, even if advised of the possibility of such damages.

VI. Binding Arbitration and Class Action Waiver

  1. Agreement to Arbitrate:
    Any dispute, claim, or controversy arising out of or relating to these Terms, ticket purchase, or attendance at Frosty’s Christmas Bar Chicago shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (AAA), and judgment upon the award may be entered in any court of competent jurisdiction.

Both parties waive the right to a trial by jury.

  1. Class Action Waiver:
    You agree that any claim shall be brought only in your individual capacity and not as part of a class, collective, or representative action. No arbitration may be joined with another without the written consent of all parties.
  2. Location and Law:
    Unless otherwise required, arbitration shall occur in Cook County, Illinois, and be governed by the laws of the State of Illinois and the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
  3. Informal Resolution Requirement:
    Before initiating arbitration, the complaining party must send written notice describing the dispute and relief sought to:

    Both parties agree to attempt to resolve the dispute informally within sixty (60) days of notice before commencing arbitration.

VII. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Illinois and the City of Chicago. If arbitration is not elected by either party, disputes shall be brought exclusively in the courts of Cook County, Illinois.

VIII. Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

IX. Entire Agreement

These Terms constitute the entire understanding between you and Viper Room Inc. regarding ticket purchase and attendance at Frosty’s Christmas Bar Chicago and supersede all prior representations or agreements.

X. Acknowledgment

By completing your ticket purchase or entering the venue, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the waiver of liability, assumption of risk, class-action waiver, and agreement to binding arbitration.
